As a litigator with over 19 years of experience, Jose has represented cooperative and condominium Boards in a wide range of litigation and non-litigation matters. Those include landlord-tenant disputes; disputes involving commercial tenants; contract disputes; residential and commercial foreclosure actions; discrimination claims brought in court or administrative agencies; actions or proceedings to abate violations of cooperative and condominium governing documents; auction and foreclosure sales of cooperative and condominium apartments; and actions or proceedings commenced by unit owners against cooperatives and condominiums.

In representing Boards, Jose has litigated in and appeared before state trial and appellate courts; federal bankruptcy courts; and various administrative agencies. Those agencies include the New York City Department of Housing Preservation and Development; the New York City Department of Buildings; and the New York State Division of Human Rights.

Apart from the litigation aspect of his practice, Jose advises Boards on matters relating to corporate governance including, but not limited to, the interpretation and enforcement of and amendments to By-Laws, proprietary leases and rules and regulations; Boards’ obligations under applicable federal, state, and local laws, which include laws governing the fiduciary duty of Boards members and obligations of Boards under antidiscrimination laws; and devising practical, cost effective and non-litigation solutions to day-to-day issues, e.g., noise disputes, disputes between shareholders or condominium unit owners, etc., that arise in cooperative and condominium communities.
